ForeverCar Holdings, Inc. and all of its subsidiaries (including but not limited to Automakerwarranty.com d/b/a ForeverCar and ForeverCar Consumer Credit LLC) collectively ForeverCar values your privacy. In this Privacy Policy, we describe the information we collect from you when you apply for a vehicle service contract, mechanical breakdown insurance or other ancillary products through our website, www.forevercar.com (the “Site”), any mobile versions of this Site, and through other interactions with you (e.g., surveys, email/phone correspondence, etc.) and how we will use and disclose that information. We also describe your choices regarding use, access and correction of your personal information.

By using this Site and the online products and services (“Services”), your information, including personal information, will be handled as described in this Privacy Policy.

Information We Collect About You

We collect information directly from you and from our Business Partners about you as you use the Site and Services. “Business Partners” means credit unions, our affiliates, service providers, and other businesses we work with to provide products and services.

Information We Collect Directly From You

When You Apply for a Product. We collect information, including personal information, directly from you when you visit this Site, such as when you become a member (e.g., register); purchase products through this Site and request information through this Site. When you register with our Site, we will collect your name and your email address, at a minimum. If you choose to apply for a Vehicle Service Contract or Mechanical Breakdown Insurance, we will collect information about your vehicle, including make and model, age of vehicle, mileage of vehicle, Vehicle Identification Number (VIN), or similar information. We also will collect billing and contact information. You may provide us personal information over the phone. If you provide this information to us and are a registered member, then we may maintain this information as part of your profile.

Surveys and Focus Groups. From time to time, we may invite you to participate in a survey or a focus group. We will collect the responses you provide and aggregate them with those of other participants.

User Generated Content. Portions of our Site allow you to submit your own content. We may use the information you submit in those portions with other information we have collected about you. Any information you post to our site, such as to a blog or a forum, may be viewable by any other visitor to our Site. We are not responsible for the privacy of any information you choose to post to our Site, or for the accuracy of any information contained in those postings.

Contacting Us. If you contact us via this Site, email, phone, or other means, we will collect the information that you provide to us during that contact and we may combine it with other information that we maintain about you.

Blog. Our website offers publicly accessible blogs or community forums. You should be aware that any information you provide in these areas may be read, collected, and used by others who access them. To request removal of your personal information from our blog or community forum, contact us at support@forevercar.com. In some cases, we may not be able to remove your personal information, in which case we will let you know if we are unable to do so and why.

Testimonial.We display personal testimonials of satisfied customers on our website in addition to other endorsements. With your consent, we may post your testimonial along with your name. If you wish to update or remove your testimonial, you can contact us at support@forevercar.com.

Refer a Friend. If you participate in our Refer a Friend program, we will collect your email address and your friend’s email address. We may store both addresses for future use, including the sending of promotional emails. Your friend may contact us at support@forevercar.com. to request that we remove this information from our database.

Business Partners. We collect information about the claims you make under the Vehicle Service Contract or Mechanical Breakdown Insurance. We use this information for analytical purposes to improve our offerings and to gain customer feedback.

Information We Collect Automatically. We use cookies, web beacons, and other automated devices to collect information about visitors to this Site. Specifically, we may collect the following information about your use of our Site via these technologies: your browser type and operating system; web pages you view; links you click; your IP address; your device type; your interaction with the Site; and length of time you are logged into our Site. For registered users, we will associate this information with your username and combine it with other information that we have collected about you. You may opt out of this collection via the settings on your browser; but please note that some functionality may be lost.

Sensitive Personal Information. We do not collect, use or disclose sensitive personal information as defined by certain state privacy laws, including but not limited to social security number, health diagnosis, sexual orientation, racial or ethnic origin, precise geolocation, biometric information, etc.

Data Security

We take precautions to protect your information. When you submit information via the website, your information is protected both online and offline. Whenever we collect information such as credit card data, that information is encrypted and transmitted to us in a secure way. You can verify this by looking for a closed lock icon at the bottom of your web browser or looking for “https” at the beginning of the address of the webpage. While we use encryption to protect information transmitted online, we also protect your information offline. Only employees who need the information to perform a specific job (for example, billing or customer service) are granted access to personal information. The computers/servers in which we store personal information are kept in a secure environment. How We Use Your Information

We use the information that you provide to us through this Site, including your personal information for the following purposes:

  • To provide the Site and Services to you, to communicate with you about your use of the Services available on the Site, your use of the Site, and for other customer services purposes;

  • To issue invoices, administer accounts, collect and process payments;
  • To provide tips or guidance on how to use the Site, inform you of new features on this Site or provide other information that may be of interest to users;
  • To personalize the service we provide to you, tailor your experience at the Site to your interests and make more appropriate recommendations;
  • To send you emails, personalized offers and other promotions about products and services that we believe would be of interest to you, and other communications about the products and services you have purchased or available by ForeverCar; with your consent, we also may contact you with SMS text messages;
  • To manage our Site, diagnose technical problems, improve content and allocate the resources of our systems so that your experience with our Site is as efficient as possible;
  • To process and track your transactions;
  • To develop, enhance, market, sell or provide Services, or those of companies with which we have a commercial relationship;
  • To investigate, detect and protect us and other Business Partners against error, negligence, breach of contract, fraud, theft and other illegal activities;
  • To facilitate a corporate transaction in connection with the sale, merger, spin-off or other corporate reorganization of our corporation, where the information is provided to the new controlling entity in regular course of business;

  • To improve the Site and Services;

  • For any other purpose to which you consent.

Sharing Your Information

We will share your personal information with Business Partners only in the ways that are described in this privacy policy. We share your information predominantly for the purpose of providing the Services that you order through the Site.

Vehicle Service Contract Providers/Financing Companies/Joint Marketing Partners. The Vehicle Service Contracts, Mechanical Breakdown Insurance and ancillary products made available through this Site are provided by our Business Partners. We will share information we collect about you with those parties, which will use the information to facilitate our ability to provide the Services you purchase from us.

If you choose to finance your product, we will provide your information to a separate Business Partner, which will collect payment from you and handle the financing of your purchase. Also, we may jointly market other products and services on this Site with other companies. If you choose to purchase a product or service with a company we collaborate with on this Site, we will share personal information that is necessary for these companies to provide those products or services. This policy does not cover the use of your personal information by these other companies. Please review their privacy policies for a description of how they may use the information that we share about you.

Service Providers. We will disclose the information we collect about you to Business Partners, including vendors, service providers, contractors or agents who perform functions on our behalf. For example, these Business Partners may assist us in directing traffic to our Site, managing our Site and our Services, providing customer service, delivering contracts, shipping items, processing credit cards, for research, marketing, data processing or to verify your identity and your VIN number. These companies are contractually bound not to use your personal information except as necessary to provide these services, and they may not sell your data.

We also may share your information for the following reasons:

Business Transfers. If we are acquired by or merged with another company, if substantially all of our assets are transferred to another company, or as part of a bankruptcy proceeding, we may transfer the information we have collected about you to the acquiring company. You will be notified via email and/or a prominent notice on our website, of any change in ownership, material uses of your personal information, and choices you may have regarding your personal information that result from a business transfer.

In Response to Legal Process. Cookies and Other Tracking Technologies

We and our Business Partners use cookies or similar technologies to track user activity and collect website and application data. You can control the use of cookies at the individual browser level, but if you choose to disable cookies, it may limit your use of certain features or functions on our website. We may combine this data with the personal information we have collected from you.

Web Beacons, Pixel Tags and Other Technologies. We use web beacons, such as clear GIFs, web bugs or pixel tags, which are tiny graphics with a unique identifier similar in function to cookies. In contrast to cookies, which are stored on your computer’s hard drive, clear GIFs are embedded invisibly on web pages. We may use clear GIFs in connection with our Site to, among other things, track the activities of website visitors, help us manage content, and compile statistics about website usage.. We and our service providers also use clear GIFs in HTML emails to our customers, to help us track email response rates, measure the success of our marketing campaigns, identify when our emails are viewed and track whether our emails are forwarded. We use technologies such as scripts in analyzing trends, administering the website and tracking users’ movements around the site. We may receive reports based on the use of these technologies by these companies on an individual and aggregated basis.

Site Analytics. As is true of most websites, we gather certain information automatically and store it in log files. We may combine this automatically collected log information with other information we collect about you. We do this to improve services we offer you and to improve site functionality.

Do Not Track. We do not currently support the capability to respond to web browser “do not track” signals.

Google Analytics. We use a tool called “Google Analytics” to collect information about use of our website. This tool uses persistent cookies to allow us to see behavior information relating to visitor age, gender and interests. Visitors can opt-out of Google Analytics for Display Advertising and customize Google Display Network ads using Google’s Ad Settings(opens in a new window). Third party links may be available on the Site. When you click on a third party’s link from the Site, you will enter that third party’s site, over which we have no control. Changes to the Privacy Policy and Changes

We may change or supplement this Privacy Policy from time to time. If we make a material change to this Privacy Policy, we endeavor to notify you of the change by posting prominently on the Site in this Privacy Policy and/or by emailing registered users of the change.

How to Access, Modify or Close Your Account

Upon request, we will provide you with information about whether we hold any of your personal information. You may opt-out of receiving email communications from us by following the instructions contained in the email. You also may modify your communications preferences by accessing your account. You may correct, update, amend, delete/remove or modify the information in your account by logging into your account or by emailing our Customer Support at support@forevercar.com. We will respond to your request to access within a reasonable timeframe. If you request that we close your account, we will promptly do so, to the extent possible. Once your account is closed, however, you will not be able to use many of the services available on our Site to Members, unless you re-register. We will retain your information for as long as your account is active or as needed to provide you services. We will retain and use your information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

Children and minors

We do not knowingly collect personal information directly from individuals under 17 years of age. Our services are not intended for individuals under 17 years of age. No one under 17 years of age should submit or post personal information through our services. We may collect personal information regarding individuals under 17 years of age from their parents or legal guardians, but only as necessary to provide our products and services.

International Users

This website is based and administered in the United States of America. The website is governed by the laws of the United States and is not directed at users based outside of the United States.

The personal information we collect about you includes information within the categories below. These categories are defined by California law and represent the personal information that we have collected about California residents, and how it has been shared, over the past 12 months.   • Right to opt-out of sale or share – We currently do not sell your personal information, nor do we share your personal information for targeted advertising to third parties, and therefore we do not offer this option. We may share personal information about you with our Business Partners as permitted by law.
  • Right to limit the use of sensitive personal information – We do not collect, use or disclose sensitive personal information as defined by state privacy laws, including but not limited to social security number, health diagnosis, sexual orientation, racial or ethnic origin, precise geolocation, biometric information, etc., and therefore do not offer this option.
  • Right to correct – You have the right to correct certain personal information. There are many types of correction requests, and our service areas are ready to assist.
  • Right to deletion – Subject to certain conditions, you may be entitled to request that we delete personal information about you. Before deleting information, we must be able to verify your identity. We will not delete personal information about you when the information is required to fulfill a legal obligation, is necessary to exercise or defend legal claims, or where we are required or permitted to retain the information by law.

We do not discriminate against you if you choose to exercise these rights. To submit personal information requests under state privacy laws, please contact 844-392-4797 or support@forevercar.com. For some personal information requests, we may verify your identity before fulfilling your personal information request which may include verifying your customer information and/or contact information. If you would like to appoint an authorized agent to make a request on your behalf, and that agent is not already authorized to access your account in your profile, we require you to verify your identity with us directly before we provide any requested information to your approved agent. In some states, you have the right to appeal our denial to act within a reasonable time or a denial of a request. Please contact us if you have an appeal.
